What Is Drag Racing?

Drag racing is a crime in Arizona. ARS 28-708 provides that a person “shall not drive a vehicle or participate in any manner in a race, speed competition or contest, drag race or acceleration contest, test of physical endurance or exhibition of speed or acceleration or for the purpose of making a speed record on a street or highway.” Violating this offense is considered a class 1 misdemeanor, which is punishable by a fine up to $250 and ordered to perform community restitution. If a person violates the law again within 24 months of the original violation can be found guilty of a class 6 felony and will not be eligible for probation, pardon, or suspension of their sentence until the offender has served at least ten days in jail. Additionally, the offender can have their license suspended by the Arizona Department of Transportation.

While the offender does not have to be convicted of a crime in order for you to pursue financial compensation from them, a conviction can serve as strong evidence of the offender’s reckless conduct. Individuals who cause accidents through criminal conduct like street racing may be ordered to pay compensation to the victims of their action.

Compensation for Drag Racing Accident Claims

In typical car accident crashes, you can recover compensation for the losses you suffer, including:

  • Medical expenses
  • Lost wages
  • Reduced earning capacity
  • Pain and suffering
  • Emotional and mental anguish and distress
  • Property damage

In addition to these traditional damages, you may also be able to recover punitive damages. This special type of damages is intended to punish wrongdoers for their bad actions. These damages are reserved for particularly egregious cases, including those that involve intentional or reckless behaviors, which may apply in cases involving illegal street racing.

Statute of Limitations for Car Accidents in Arizona

The statute of limitations for most personal injury claims in Arizona is two years. This means you generally only have two years from the date of the accident. However, there are times when the time limit may be different, so it is important to discuss your case with a qualified lawyer for help.
