Article 10-13 – Unruly Gatherings – Town Code of Paradise Valley

This Code gives police officers in Paradise Valley the authority to disperse gatherings of more than five people that have become unsafe to the public welfare on private property. If a police officer responds to a gathering and determines that there is a threat to the public peace, health, safety, or general welfare, they may issue a citation to the organizer and disperse the participants. People who may receive a citation include any responsible party. If the police are forced to respond with more than two officers to a gathering of more than 11 people, then the responsible party may be liable to pay for the police response’s cost.

“Unruly Gathering” Penalties

A responsible party includes any person in attendance, including the owner, occupant, tenant, or host who was aware of the social gathering. The police can charge all responsible parties with a class one misdemeanor. If the property owner was not present but aware that an Unruly Gathering had occurred in the last 180 days, then the police can charge them with a civil infraction. If the Responsible Party is younger than 18 years, their parent or guardian can also be criminally liable. Any person who remains after the officers have given notice that the gathering is unruly may be subject to arrest.

Dealing with an Unruly Gathering Citation

If you have been charged with organizing an Unruly Gathering, then there are legal options. The Arizona Constitution guarantees the right to peacefully assemble for the common good. Additionally, the Code allows for Owners to apply for a town event permit retroactively. If it is the first offense, the owner was present, and the owner made contact with the responding officers, they may be able to file a special event permit and avoid criminal or civil liability. Remember, time is of the essence in these situations, as this must be done by the close of the next business day.
